Richard H. Andre
conducts a general corporate and estate planning practice.
Born and raised in Chicago, Illinois, he graduated from Yale
University in 1975. Mr. Andre began practicing law in
Atlanta in 1980 after graduating from Emory University
School of Law.
One focus of Mr. Andre’s practice is
to assist clients in the establishment, acquisition, and
management of businesses of all types. In the course of
providing counsel to business owners, Mr. Andre has worked
extensively in the negotiation and drafting of agreements
between shareholders and partners, contracts of employment,
and agreements for distributors and licensing arrangements.
As an integral part of this process, Mr. Andre provides
counsel in all aspects of the taxation issues that the
business activity triggers as well as deferred compensation
and estate planning. In this practice, Mr. Andre has
provided legal services in many disputes between
shareholders and partners, including the negotiation of the
“buy-out” of one or more owners and tax-free split-ups of
the business operations. In addition, Mr. Andre provides
guidance to the business owners with respect to employee
benefits, personnel policies and the other issues that arise
as a business plans for growth and reacts to market
conditions and regulatory initiatives.
Mr. Andre also works extensively in
the estate planning and probate areas. He advises clients
on making arrangements for the orderly transition of the
ownership of a business and in the conservation of the
business owner’s estate, as well as counseling individuals
on establishing wills and trusts that will reduce estate
taxes, protect assets and provide benefits for the surviving
family members.
Mr. Andre is a member of the Atlanta
Estate Planning Council, The Georgia Planned Giving Counsel,
the Atlanta Bar Association and the State Bar of Georgia and
its Fiduciary Law Section. Mr. Andre is also a member of
The Executive Committee-Atlanta Group 151 and the Yale Club
of Georgia. Mr. Andre has served on the Board of Directors
of several non-profit organizations and has been active in
various local political campaigns.
